LAINE'S 'TERMS AND CONDITIONS OF SALE'
All orders for goods or services accepted by Laine's ("Elaine Paterson T/A Laine's") are accepted subject to the following conditions which shall form part and govern the contract of sale. Acceptance of goods shall be deemed to be acceptance of these conditions of sale.
1. Payment and Price (a) Price Lists do not constitute an offer. (b) All invoiced goods are due for payment on the date of invoice. 30-day accounts are available to certain organizations or individuals upon request, subject to acceptance. (c) Payment is to be made in sterling, cheque or Cash. Orders paid by cheque, will not be dispatched until the cheque has cleared, for which up to 14 days should be allowed. Personal cheques may be cleared immediately provided a valid cheque guarantee card number and expiry date is written on the reverse of the cheque. Do not send cash through the post or by carrier. Postal/Money Order Only UK Sterling Postal Orders accepted. Please cross the order with the words A/C PAYEE ONLY. Lainesworld online Secure Shopping facility accepts payment by Visa, Mastercard, Switch, Solo and Cheque. Your Credit/Debit Card will not be debited until goods are dispatched. On payments made by PayPal the full amount will be debited on despatch of your order. On all other payment types items will be charged for as they are despatched. Split orders will only be despatched to UK destinations. All non European Union orders will incur a 15% handling charge, which is included in the price shown. A customs declaration will accompany all non European Union orders. Any Import duty payable is the responsibility of the customer
2. Availability of Goods. Inclusion on Laine's Price list does not mean goods are in stock. Laine's endeavours to comply with the date named for dispatch or delivery. The date is given and intended as estimate only and is not to be the essence of the contract. If owing to non-availability of goods or any other causes beyond Laine's control, Laine's shall be unable to effect delivery, and accepts no liability. The customer will be informed immediately of non available goods. Non available goods will be refunded in full. Customers will be informed via email of dispatch of goods. If the customer is unable to accept delivery of goods, an alternative delivery date may be arranged or a full refund offered.
3. Delivery of Goods. Laine's endeavours to dispatch On-Line orders within 1-5 days. Certain items are delivered direct from our suppliers. These items may take between 10-21 days. These items are described as such in the catalogue. The customer will be provided with an estimated delivery date for these items along with an option to cancel. within 24 hours of placing the order. (longer over weekends and public holidays). If items are temporarily out of stock and dispatch is anticipated to be after the five day period. the customer will be contacted by email or phone to agree on a new delivery date. If this date is unsuitable, a full refund will be offered.
4. Property and Risk. For so long as any amounts remain owing from the purchaser to Laine's (whether immediately due or not) title to the property of the goods shall remain that of Laine's and ownership will not pass to the purchaser until the Laine's has received payment in full.
5. Product Information. Product images, descriptions and approximate dimensions have been designed to give as much information as possible about the product. Product images are not displayed to actual size. Where necessary products will be labelled " NOT AS ILLUSTRATED" when images are used as for guidance purposes only. Addition Product information can be requested at any time.
6. Claims. (a) No liability for any claim for damage or non-functionality shall be accepted unless the purchaser notifies Laine's in writing (via post, electronic mail or fax) within a reasonable time after delivery. (b) No liability for any claim will be accepted in the case of goods differing in quantity or descriptions from the particulars given on the delivery note unless Laine's is notified in writing by the purchaser within a reasonable time of delivery and the onus is on the purchaser to prove any shortage. This does not affect your statutory rights as a consumer.
7. Consumer Protection (Distance Selling) Regulations 2000.All purchases made via our Online Store whether placed by Telephone, Fax or mail order, are subject to the UK Distance Selling Regulations.
8. Returned Goods. Not covered by Distance Selling Regulations (section 7 above) (a) The vendor will not accept goods for credit or refund unless such return has been authorized by Laine's, and the goods are received by Laine's in stock condition, with original packaging. (b) The purchaser shall unless otherwise stated, or goods are being returned under the Distance Selling Regulations be responsible for the cost of outward and return carriage and insurance of all goods returned by the purchaser to Laine's for refund or credit which goods shall be at the risk of the purchaser until actual receipt of the goods by Laine's. The onus of proof of safe delivery shall rest with the purchaser. (c) Laine's shall refund postal expenses on returns of faulty or incorrectly supplied goods.(d) No credit or refund shall be made for goods until they have been received complete.
9. Complaints Procedure. Laine's endeavours to respond complaints within five working days. We promise to deal with all complaints confidentially and in a fair, speedy and effective manner. This contract is and shall be deemed to have been made in Scotland and shall in all respects be governed by Scottish Law. Your statutory rights are unaffected by these terms and conditions.
